TERMS AND CONDITIONS

1. DEFINITIONS AND TERMS

"Archery One - my.archery.store" — is the trade name of the company OXYGEN ART TRADING S.R.L., a Romanian legal entity, with its registered office in Cluj County, Cluj-Napoca, Str. Branului, No. 31, registered in the Trade Register under J12/2048/2014, with the unique fiscal registration code RO33331906 (hereinafter referred to as "Archery One - my.archery.store" or “we”).

Seller - "Archery One - my.archery.store"

Buyer - can be any natural person over 18 years old, a legal entity, or any legal entity that creates an Account on the Website and places an Order.

Client - can be any natural person over 18 years old or a legal entity that has or obtains access to CONTENT through any means of communication provided by "Archery One - my.archery.store" (electronic, telephone, etc.) or based on an existing usage agreement with "Archery One - my.archery.store" and which requires creating and using an Account.

User - any natural person over 18 years old or registered legal entity on the Website, who, by completing the account creation process, agrees to the specific clauses of the site in the Terms and Conditions – this document.

Account - the section of the Website accessed through an email address and password, which allows the Buyer to transmit Orders and contains information about the Client/Buyer and their purchase history on the Website. The User is responsible for ensuring that all information entered when creating the Account is correct, complete, and up-to-date. Within the Website, a person or entity has the right to create only one Account.

Favorites - section of the Account that allows the Buyer/User to create a list of preferred goods or services.

Desired Products - the section where the User can add goods or services they wish to monitor for a potential purchase.

Lists can be:

Public: any Client/Buyer/User can view the Buyer’s/User’s list if it has been shared on social networks or if they access the public profile of the Buyer/User on the Website. Lists are public, and the Buyer/User can set them to private at any time directly from their Account, in the Favorites section.

Private: these can only be viewed by the account holder. The Buyer/User has the option to set them as public at any time directly from their Account, in the Favorites section.

My Cart - a section of the Account that allows the Buyer/User to add Goods or Services they wish to purchase either at the moment of addition or later; if the Goods or Services are not purchased at the time of adding through placing an Order, the Buyer/User will benefit from the service offered by the Seller of tracking the Goods and Services through the receipt of Commercial Communications from them.

Site - the online shop hosted at the web address my.archery.store and its subdomains.

Order - an electronic document serving as a communication form between the Seller and the Buyer through which the Buyer conveys their intention to purchase Goods and Services from the Website.

Goods and Services - any product or service listed on the Website, including the products and services mentioned in the Order, which are to be supplied by the Seller to the Buyer as a result of the concluded Contract.

Campaign - the act of exposing, for commercial purposes, a finite number of Goods and/or Services with a limited and predefined stock and/or for a limited period established by the Seller.

Contract - the distance contract concluded between the Seller and the Buyer, without the physical presence of both parties at the same time.

Content – means:

All information on the Website that can be viewed, accessed, or otherwise retrieved using an electronic device;
Content of any email sent to Buyers by the Seller via electronic means and/or any other available communication method;
Any information communicated by any means by an employee/partner of the Seller, to the Buyer, according to the contact details provided, whether or not specified by the Buyer;
Information related to Goods and/or Services and/or tariffs practiced by the Seller during a certain period;
Information related to Goods and/or Services and/or tariffs practiced by a third party with whom the Seller has entered into partnership contracts, during a certain period;
Illegal Content – any type of Content that does not comply with current legal regulations or this Document.
Review – a written evaluation by a User or Buyer of a Product or Service, drafted based on their personal experience and their ability to provide qualitative comments and to state whether the Product or Service, or the Seller, complies with the specifications mentioned by the manufacturer.

Rating – a way to express the level of satisfaction of a User/Buyer towards a product. Ratings are expressed in stars, with each Product or Service potentially receiving a score from one star to five stars. This satisfaction level will always be associated with the Review of a Product or Service in accordance with this Document.

Comment – an appreciation or critical observation by a User/Buyer, regarding a Review or another comment.

Question – a form of address to other Users/Buyers to obtain information about the Goods or Services on that particular page.

Answer – written information transmitted to the User/Buyer who asked a Question on the Website, on a specific Product page. The Answer is an explanation provided by one User/Buyer to another User/Buyer within a discussion.

Document – this Terms and Conditions document.

Dangerous Product – a product that does not comply with current legal regulations and/or for which a withdrawal or recall from the market has been requested.

Commercial Communications – any type of message sent (such as: email/SMS/phone/web push/web push/etc.) containing general and thematic information, information about similar or complementary products to those purchased, information regarding "Archery One - my.archery.store" offers or promotions or those of the "Archery One - my.archery.store" Group, information about Goods and Services added in the “My Account / Cart” section or the “Account / Favorites” section, as well as other commercial communications such as market research and opinion polls.

The "Archery One - my.archery.store" Group – includes:
(i) any company or entity in which OXYGEN ART TRADING S.R.L., a Romanian legal entity with its registered office in Cluj County, Cluj-Napoca, Str. Branului, No. 31, registered in the Trade Register under J12/2048/2014, with fiscal registration code RO33331906, directly or indirectly holds 50% or more of the shares or voting interests;
(ii) any company or entity that directly or indirectly holds 50% or more of the shares or voting interests of OXYGEN ART TRADING S.R.L.; or
(iii) any company or entity that directly or indirectly controls or is under the control of an entity or company described in (i) or (ii).

Transaction – the collection or refund of an amount resulting from the sale of a Product and/or Service by "Archery One - my.archery.store" to the Buyer, through the use of intermediary services, regardless of the delivery method.

Specifications – all specifications and/or descriptions of Goods and Services as detailed in their respective descriptions.

"PRP" (or "RRP", as applicable) is a recommended resale price of the Product directly provided by the manufacturer, and where applicable, through the distributor or supplier. The Selling Price is established independently by the Seller, based on its own commercial policy. The sole purpose of this information is to support the Buyer/Customer/User in making an informed decision to purchase the Product and/or Service.

The Buyer/Customer/User understands that the less prominent marking of this information is not intended to cause confusion and that, when making a purchase decision for the Product, the Buyer/Customer/User must strictly consider the Selling Price communicated by the Seller and requested by the Seller from the Buyer/Customer/User for the marketed Product.

"Washer Price" – represents the reference price, namely the lowest price practiced by the Seller at least in the last 30 days before the date of applying the price reduction to the Product. Under legal conditions, the Washer Price can be maintained even during successive, gradual discounts. The Washer Price is valid within the stock availability of the Product/Service.

"Sale Price" – represents the value of the Product, demanded and requested by the Seller from the Buyer/Customer/User, properly indicated to them on the product page on the Website, as well as on the label for products displayed in Showrooms. The Seller may visibly display the monetary difference between the Sale Price and PRP and/or the monetary or percentage difference between the Sale Price and the Washer Price. The Sale Price is valid within the stock limits of the Product/Service.

Search Algorithm – consists of two components: text relevance (a score representing the match between the search term and the Product data) and the popularity of the Product on the "Archery One - my.archery.store" platform.

Product Withdrawal / Recall – a method of withdrawing a dangerous product from the market or recalling it, which may have harmful effects on people or the environment, for safety reasons.

2. CONTRACTUAL DOCUMENTS

2.1. By placing an Order on the Website, the Buyer agrees to the communication methods (by phone or email) through which the Seller conducts its commercial operations.

2.2. The notification received by the Buyer after placing the Order serves as an information notice and does not constitute acceptance of the Order. This notification is made electronically (via email) or by phone.

2.3. For justified reasons, the Seller reserves the right to modify the quantity of Goods and/or Services in the Order. If the Seller modifies the quantity of Goods and/or Services in the Order, it will notify the Buyer at the email address or phone number provided during Order placement and will refund the amount paid.

2.4. The contract is considered concluded between the Seller and the Buyer at the moment the Buyer receives the shipping notification of the Order from the Seller via email and/or SMS and/or WhatsApp message.

2.5. For Orders to be picked up from the "Archery One - my.archery.store" showrooms and delivery points, the prices and reservations of Goods and/or Services are valid for 72 (seventy-two) hours from the registration of the Order by the Buyer.

2.6. The document and information provided by the Seller on the Site will form the basis of the Contract; additionally, a warranty certificate issued by the Seller or a supplier of the Seller for the purchased Goods will serve as proof.

3. ONLINE SALES POLICY

3.1. Communication with the Seller can be conducted directly, including through online support (Live Chat) or via the addresses mentioned in the “Contact” section on the Site. The Seller has the freedom to manage the received information without needing to justify its actions.

3.2. In case of an unusually high traffic volume from an internet network, "Archery One - my.archery.store" reserves the right to require Users/Buyers to manually enter validation codes such as CAPTCHAs to protect the information within the Site.

3.3. "Archery One - my.archery.store" may publish on the Site information about Goods and/or Services and/or promotions carried out by it or by any third party with whom "Archery One - my.archery.store" has entered into partnership agreements, for a certain period or within available stock.

3.4. All fees related to the Goods and/or Services displayed on the Site are expressed in Romanian lei (RON) and include VAT.

3.5. In case of online payments, the Seller is/ cannot be held responsible for any additional costs borne by the Buyer, including but not limited to currency conversion fees applied by the issuing bank if the currency differs from RON. Responsibility for such actions lies solely with the Buyer.

3.6. All information used to describe the Goods and/or Services available on the Site (static/dynamic images, multimedia presentations, etc.) does not constitute a contractual obligation on the part of the Seller and is used solely for presentation purposes.

3.7. After 14 (fourteen) days from the purchase of a Product or Service, the Buyer will be asked to submit a Review regarding the purchased Product or Service. The request will be sent to the email address registered by the Buyer in their Account. In this way, the Buyer contributes to informing other potential Users/Customers/Buyers on the Site and actively participates in the development of new Services and in providing as complete a description as possible of the Product features.

4. ASSIGNMENT AND SUBCONTRACTING

4.1. Access to use the Website and place an Order is permitted to any User/Buyer, as long as they use the Website in accordance with this Document and applicable regulations.

4.2. Abusive use of the Website or for purposes other than those expressly authorized by "Archery One - my.archery.store" is prohibited, and "Archery One - my.archery.store" will not be responsible for any damage caused by unauthorized use. Specifically, the following actions are forbidden:
a. Non-compliance with payment obligations or any obligations towards Sellers or "Archery One - my.archery.store";
b. Placing Orders for purposes other than purchasing Goods or Services;
c. Providing false, inaccurate, or outdated information when creating the Account, including indicating a false identity through any means (e.g., using an email address, name, pseudonym, or otherwise);
d. Creating multiple Accounts by the same individual or legal entity;
e. Violating the confidentiality of login details to the Account;
f. Engaging in actions that are illegal, immoral, against public security, or other actions and omissions that breach applicable regulations;
g. Using any external software tools that may disrupt the normal operation of the Website;
h. Attempting to interfere with the operation of hosting servers or the Website by any means;
i. Assigning, copying, decompiling, or attempting to discover the source code of the Website or its content;
j. Using any robots, algorithms, or other automated tools to read the source code or extract data from the Website;
k. Attempting to test or scan vulnerabilities of any system within the Website by accessing non-public servers or services without authorization, including attempts to interfere with the operation of hosting servers or the Website;
l. Publishing content that praises, promotes, encourages, or incites terrorism, racism, revisionism, xenophobia, homophobia, sexism, hate speech, discrimination, human trafficking, organized crime, illegal organizations, self-harm, suicide, torture, cruelty against animals, justification of war crimes, sexual exploitation of children and/or adults, cultures, or any other illegal Content;
m. Engaging in actions that could harm the interests of "Archery One - my.archery.store," directly or indirectly, including making defamatory statements against "Archery One - my.archery.store," its employees, representatives, or partners, as well as regarding the IT systems provided by its partners or by "Archery One - my.archery.store"; adopting public positions that could negatively impact "Archery One - my.archery.store" or its services.

4.3. For justified reasons, in case of non-compliance with the provisions of this Document or legal regulations, "Archery One - my.archery.store" reserves the right to apply one or more corrective measures, such as:
a. Suspending or closing the Account or restricting access to the Website or certain functionalities (e.g., in cases of repeated or serious violations, such as providing false information when creating the Account, using someone else's personal data);
b. Limiting or suspending the User’s/Buyer’s access to place Orders (e.g., in cases of frequent placement of false Orders that are subsequently canceled);
c. Restricting the User’s/Buyer’s access to certain accepted payment methods (e.g., in cases of multiple Orders where the chosen payment method proves to lack sufficient funds to fulfill the Orders);
d. Suspending the visibility or deleting Comments, Questions, Reviews, or other published information (e.g., if they contain offensive, insulting, or discriminatory remarks, or other situations).
e. Suspending the User’s/Buyer’s ability to submit Reviews/Comments/Questions or Answers in the sections “Customer Questions and Answers” and “Reviews” (for example, in cases of repeated violations of this Document).

4.4. In addition to the above corrective measures, "Archery One - my.archery.store" may suspend processing of notifications or complaints submitted through the Site according to art. 20.2, or complaints submitted through the internal complaints resolution system, against persons who frequently submit notifications, complaints, or proceedings that are clearly unfounded or excessive, especially due to their repetitive nature (for example, with harassing intent, content that does not notify a real situation, etc.).

4.5. To detect violations, "Archery One - my.archery.store" may use automated software or technology or inspections performed manually by a person. In all cases, the decision regarding the violation and/or application of a corrective measure is made by a person.

4.6. Any examples provided by "Archery One - my.archery.store" in this Document, including regarding prohibited actions or corrective measures, are purely illustrative. The corrective measures adopted by "Archery One - my.archery.store" may vary from case to case, depending on the specific circumstances, and will be tailored to the particularities of each situation.

4.7. The corrective measures will be proportionate and will take into account the interests of involved parties, all relevant facts and circumstances that emerge from the information available to "Archery One - my.archery.store", including:
a. Frequency of violations – the absolute number of elements of illegal Content or obviously unfounded notifications or complaints transmitted within a certain period, and the relative proportion of that number in relation to the total number of pieces of information provided or notifications transmitted within a certain period (for example, in the case of 3 violations committed within a 6-month period, more restrictive corrective measures will be applied, such as suspension or closing of the Account, compared to if the 3 violations are committed within 2 years);
b. Seriousness of the violation, including, where appropriate, the nature of the illegal Content and its consequences (for example, in cases of very serious violations, such as incitement to terrorism, prostitution, abuse, etc., "Archery One - my.archery.store" may apply more restrictive corrective measures, such as suspension or closure of the Account);
c. Intent of the person who committed the violation, if identifiable (for example, in cases where certain Comments, Questions, or Reviews are posted solely to damage the reputation of "Archery One - my.archery.store").

4.8. Corrective measures will be taken with prior notice to the person affected. However, in exceptional situations where the nature of the violation requires it, "Archery One - my.archery.store" may implement corrective measures without prior notice. "Archery One - my.archery.store" will promptly inform the affected person about:

a. the corrective measure and, if applicable, the duration for which it applies;
b. the reasons and facts that underpin the corrective measure, including whether it resulted from a voluntary action by "Archery One - my.archery.store" or from a notification received from "Archery One - my.archery.store";
c. as applicable, information indicating whether the corrective measure was taken regarding illegal Content detected or identified through automated means;
d. the facts and the legal basis or relevant provisions of this Document on which the corrective measure was based;
e. information about available appeal procedures.
The above information will not be provided if releasing it by "Archery One - my.archery.store" would constitute a violation of law, breach of a legal order, or would otherwise interfere with an investigation.

4.9. In any of these cases, the affected person may contact "Archery One - my.archery.store" to be informed about the reasons that led to the application of the aforementioned measures.

5. ASSIGNMENT AND SUBCONTRACTING

5.1. The Seller may assign and/or subcontract third parties for Services related to fulfilling Orders, informing the Buyer, without requiring their consent. The Seller will always be responsible to the Buyer for all contractual obligations.

6. INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS

6.1. The Content, as defined in the preamble, including but not limited to logos, stylized representations, trademarks, static images, dynamic images, text, and/or multimedia content presented on the Site, are the exclusive property of "Archery One - my.archery.store," which reserves all rights obtained in this regard, directly or indirectly (through licenses for use and/or publication).

6.2. The Client/Buyer/User is not permitted to copy, distribute, publish, transfer to third parties, modify, or otherwise alter, use, link to, display, include any Content in any context other than the original intent of "Archery One - my.archery.store," include any Content outside the Site, remove marks indicating the copyright of "Archery One - my.archery.store" over the Content, or participate in the transfer, sale, or distribution of materials created through reproducing, modifying, or displaying the Content, except with the explicit written consent of "Archery One - my.archery.store."

6.3. Any Content to which the Client/Buyer/User has and/or obtains access by any means falls under this Document, provided that the Content is not accompanied by a specific and valid use agreement concluded between "Archery One - my.archery.store" and the user, and without any implicit or explicit warranty from "Archery One - my.archery.store" regarding that Content.

6.4. The Client/Buyer/User may copy, transfer, and/or use the Content only for personal or non-commercial purposes, provided that doing so does not conflict with the provisions of this Document.

6.5. If "Archery One - my.archery.store" grants the Client/Buyer/User the right to use certain content under a separate usage agreement, the scope of this right will be limited solely to the content specified in the agreement, only for the duration of its existence on the site or the period defined in the agreement, according to its terms, if such exist. This does not constitute a contractual obligation from "Archery One - my.archery.store" towards the specific Client/Buyer/User or any third party who has or obtains access to this transferred content by any means and who may be or is harmed in any way by this content, during or after the expiration of the usage agreement.

6.6. No Content transmitted to the Client, User, or Buyer, via any communication means (electronic, telephone, etc.) or obtained through access, visit, or viewing, constitutes a contractual obligation from "Archery One - my.archery.store" or its employee/representative who facilitated the transfer regarding the respective content.

6.7. Any use of the Content for purposes other than those explicitly permitted in this Document or the accompanying usage agreement, if such exists, is prohibited.

7. ORDER

7.1. The Client/Buyer can place Orders on the Website by adding the desired Goods and/or Services to the shopping cart, then completing the Order by making payment through one of the explicitly indicated methods. Once added to the shopping cart, a Good and/or Service is available for purchase insofar as stock is available. Adding a Good/Service to the cart without completing the Order does not automatically record an order nor reserve the Good/Service.

7.2. By completing the Order, the Buyer agrees that all data provided by them, necessary for the purchasing process, are correct, complete, and truthful at the time of placing the Order.

7.3. By finalizing the Order, the Buyer agrees that the Seller may contact them by any available/agreed means whenever needed to contact the Buyer.

7.4. The Seller can cancel an Order placed by the Buyer following prior notification to the Buyer, without any further obligation for either party or any damages claimed by either side, in the following cases:

7.4.1. Non-acceptance by the issuing bank of the Buyer's card of the transaction in case of online payment;
7.4.2. Invalidation of the transaction by the payment processor approved by "Archery One - my.archery.store," in case of online payment;
7.4.3. Incomplete or incorrect data provided by the Client/Buyer on the Website.

7.5. The individual Buyer has the right to withdraw from the Contract, that is, to return a Product or to no longer require a Service, within 14 calendar days, without providing any reason and without incurring other costs than those for delivery. According to GEO 34/2014, the withdrawal period expires 14 days from the day the Buyer acquires physical possession of the entire Product.

7.6. If the Buyer decides to withdraw from the Contract, they may contact "Archery One - my.archery.store" to notify them of this decision.

7.7. If the Client/Buyer, a natural person, requests to withdraw from the Contract within the legal withdrawal period, they must also return any gifts accompanying the product. If the Order has been paid for, the Seller will refund the amount within a maximum of 14 (fourteen) days from the date the Seller is informed of the Buyer’s decision to withdraw from the Contract. The refund will be made as follows:

7.7.1. For Orders paid by bank card -> via refund to the account from which the payment was made or by generating a voucher with the value of the returned product;
7.7.2. For Orders paid by bank transfer -> via bank transfer or by generating a voucher with the value of the returned product;
7.7.3. For Orders paid cash on delivery/in-store -> via cash refund in the showroom, or by refunding the value of the product to the bank account provided by the customer, or by generating a voucher with the value of the returned product.

7.8. The Seller may delay refund until the returned Goods are received or until proof of shipment is provided, in case the Seller does not retrieve the Goods themselves (the most recent date will be considered). 

7.9. If the Good is returned in a condition that makes it unsellable as new (opened packaging, missing accessories, damaged Product), we reserve the right to charge a fee to restore the Good to its original condition, or to cover the difference in resale value for a resold or resigilated product, or, at the Buyer's request, we will resend the Good, with shipping costs borne by the Buyer. For more details on product returns, please consult the “Return Information” section.

Value reduction of Returned Goods

Since, in the case of remote sales, the Buyer does not have the possibility to verify the Goods before concluding the contract, they have the right to withdraw from the contract. For the same reason, the Buyer is allowed to test and inspect the Goods purchased to the extent necessary to establish the nature, characteristics, and functioning of the Goods. 

To determine the nature, features, and operation of the Goods, the Buyer must handle and inspect them in the same way as they would in a physical store. For example: the Buyer should only stretch a bow, not shoot with it during training. 

The Buyer is responsible only for the reduction in value resulting from handling that exceeds what is necessary to determine the nature, characteristics, and functioning of the Goods. 

If the Buyer exercises their right of withdrawal after using the Goods in a manner that exceeds this necessary limit, the Buyer is responsible for any resulting decrease in the value of the Goods.

Accessories received with the Goods, as well as the original packaging, are an integral part of the Goods. Therefore, when exercising their right to withdraw, the Buyer is advised to return the Goods in their original, undamaged packaging, protected by stretch plastic wrap or packed in a cardboard box (without attached labels, tears, cuts, etc.) and with all accessories. 

Returned Goods showing signs of wear (stains, scratches, bends, cracks, dents, etc.) are only accepted if brought back into compliance, involving costs for sanitizing, cosmetics, repair, replacement of damaged parts, and restoring them to a commercial condition for resale as a Reconditioned/Resigilated product. The final value is determined based on the cost of parts to be replaced, reconditioning labor, or as the difference between the initial value of the new product and the resale value of the used product.

Any reduction in the value of Goods resulting from handling beyond what is necessary to determine their nature, characteristics, and functioning is the responsibility of the Buyer. For clarity, the Seller will retain from the total price of the returned Goods an amount corresponding to the reduction in value. The amount of this reduction fee will be communicated to the Buyer upon receipt of the returned Goods.

7.10. If a Product and/or Service ordered by the Buyer cannot be delivered by the Seller, the latter will inform the Client/Buyer of this fact and will refund the amount to the Buyer's account within a maximum of 7 (seven) days from the date the Seller became aware of this fact or from the date the Buyer explicitly expressed their intent to terminate the Contract.

7.11. If this information is available, the availability of a Product will be displayed on the Site as follows:

- “in stock” — we have multiple units in stock at "Archery One - my.archery.store";
- “limited stock” — we have few units left at "Archery One - my.archery.store";
- “on order” — the Product is not available in stock at "Archery One - my.archery.store" and we currently have no information about its availability at the supplier’s stock. However, if you place an Order for a Product marked “on order,” one of our sales consultants will check its availability at the supplier’s stock and will contact you to inform about the Product’s availability.

8. GOODS/SERVICES FOR WHICH THE RIGHT OF WITHDRAWAL IS NOT GUARANTEED

8.1. The following are exempt from the right of withdrawal from the Contract:

8.1.1. Service contracts, after the full performance of the services, if the execution began with the prior explicit consent of the Buyer and after they confirmed that they are aware that they will lose the right to withdraw after the full execution of the Contract by the Seller;
8.1.2. The provision of Goods and/or Services whose price depends on fluctuations in the financial market that the Seller cannot control and which may occur during the withdrawal period;
8.1.3. The provision of Goods made according to the Buyer’s specifications or clearly personalized;
8.1.4. Contracts where the Buyer has specifically requested the Seller to go to their residence to carry out urgent repair or maintenance work. If, during such a visit, the Seller provides additional services beyond those explicitly requested by the Buyer or supplies other Goods than the essential spare parts for repairs or maintenance, the right to withdraw applies to those additional Services or Goods;
8.1.5. Digital content that is not delivered on a tangible medium, provided that the performance began with the prior explicit consent of the Buyer and after the Buyer confirmed they are aware they will lose the right to withdraw.

9. CONFIDENTIALITY

9.1. "Archery One - my.archery.store" will keep confidential all types of information provided by you. Disclosure of provided information can only be made under conditions mentioned in this Document.

9.2. No public statement, promotion, press release, or any other form of disclosure to third parties related to an Order/Contract shall be made by the Buyer/Client without prior written consent of the Seller.

9.3. By transmitting information or materials through this site, you give the Seller unrestricted and irrevocable access to these, with the right to use, reproduce, display, modify, transmit, and distribute these materials or information. "Archery One - my.archery.store" will not consider these transmissions as confidential unless otherwise specified by law.

10. COMMERCIAL COMMUNICATIONS

10.1. The Buyer/User/Client can modify at any time their option regarding the consent given to "Archery One - my.archery.store" for Commercial Communications containing general and thematic information, including details about offers or promotions, by contacting the Seller.

10.2. By adding Goods or Services to the section in the Account:

"My Cart", the Seller will send Commercial Communications to the Buyer/User regarding:

- changes to the price of Goods or Services added to "My Cart",
- recommendations of Goods or Services similar to those added to "My Cart",
- the existence of Goods or Services in "My Cart" and the stock availability of the Goods or Services added there.

"Favorites", the Seller will send Commercial Communications to the Buyer/User regarding:

- changes to the price of Goods or Services added to "Favorites",
- recommendations of Goods or Services similar to those added to "Favorites",
- stock availability of Goods or Services added in the "Favorites" section.

10.3. After purchasing a Product or Service, the Seller will send the Buyer/User Commercial Communications regarding:

- suggestions of Goods or Services recommended to be used together with the purchased Item.

10.4. The Client/User can unsubscribe at any time from the Commercial Communications by accessing the unsubscribe link displayed in the promotional messages received from "Archery One - my.archery.store" or by contacting "Archery One - my.archery.store" for this purpose.

10.5. Additionally, to enhance the offer of Goods and Services and improve the shopping experience, we will use your data to conduct market research and opinion polls. The information obtained through these market research activities and opinion surveys will not be used for advertising purposes but only for the aforementioned activities. Your responses to these surveys will not be associated with your identity, nor will they be transmitted to third parties or published. You can object to the use of your data for market research and opinion polls at any time by accessing the unsubscribe link in the message or by contacting "Archery One - my.archery.store".

11. INVOICING - PAYMENT

11.1. The prices of Goods and Services displayed on the website www.my.archery.store include VAT in accordance with current legislation.

11.2. The price, payment method, and payment deadline are specified in each Order. The Seller will issue an invoice to the Buyer for the Goods and Services delivered, and the Buyer's obligation is to provide all necessary information for invoicing in accordance with applicable legislation.

11.3. The Seller will send the invoice related to the Order containing the Goods and/or Services sold by "Archery One - my.archery.store," as well as for any other payments related to the Order, in printed form, in the package, or electronically, by adding the invoice to the Buyer's Account, via WhatsApp message, or by email, to the email address provided by the Buyer in their Account.

11.4. For correct communication of the invoice related to the Order, it is the Buyer's responsibility to update their Account data whenever necessary and to access the information and documents related to each Order stored in their Account.

11.5. By submitting the Order, the Buyer agrees to receive invoices in printed format along with the package at the address, or in electronic format via email, to the email address specified in their Account.

11.6. The payment card data of the User/Buyer will not be accessible to "Archery One - my.archery.store" nor stored by "Archery One - my.archery.store," but by the integrated payment processor on the Site, an authorized entity providing card identification data storage services.

11.7. For security reasons related to transactions, the User/Buyer is advised not to remain logged into the Site and not to set up automatic login options on mobile devices. Sharing the account password is prohibited, and it is recommended to use a strong password (e.g., at least eight characters, including uppercase and lowercase letters, numbers, and special characters).

12. GOODS DELIVERY

12.1. After placing the order, the Buyer can track its status in their customer account, under the “My Orders” section.

12.2. The Seller will ensure appropriate packaging of the Goods and will provide the necessary accompanying documents.

12.3. The Seller will deliver the ordered products via express courier.

12.4. The Seller will notify the Buyer about the tracking method of the package via email to the email address specified in their account, via WhatsApp, SMS, or phone call to one of the contact numbers in their account.

12.5. Delivery is free for orders exceeding 1000 RON.

12.6. For deliveries within Romania, the delivery fee is 26 RON for a parcel weighing up to 10 kg and with maximum dimensions of 180 cm, calculated by adding the length, width, and height of the parcel. For any order where the parcel (or combined parcels) exceeds these limits, the Seller reserves the right to change the delivery cost. In case of a change in delivery cost, the Buyer will be consulted for confirmation via email at the address provided in their Account, via WhatsApp, SMS, or phone call at one of the numbers in their account.

12.7. For deliveries to countries other than Romania, "Archery One - my.archery.store" will contact the Buyer after the purchase to present the specific transportation costs for their order and delivery destination.

13. WARRANTIES

13.1. All Goods sold through the Site, except for Resigilated Goods, enjoy warranty conditions compliant with current legislation and the commercial policies of the manufacturers. The Goods are new (except Resigilated Goods), in their original packaging, and originate from sources authorized by each manufacturer.

13.2. For Goods sold and delivered by "Archery One - my.archery.store," the receipt or invoice serves as a warranty certificate.

13.3. For Resigilated Goods, warranty conditions will be communicated directly to the Buyer at the time of purchase.

13.4. According to current legislation, the standard warranty for a product is 24 months from the date of purchase. If the Buyer is a legal entity, the standard warranty is 12 months from the purchase date.

14. TRANSFER OF OWNERSHIP OF GOODS

14.1. Ownership of the Goods will be transferred upon delivery, after payment by the Buyer (meaning delivery is either the receipt of the package from the courier or the collection of the products from the store).

15. LIABILITY

15.1. The Seller is not responsible for the behavior of Users/Clients/Buyers or any other persons on the Site and for the Content they add.

15.2. The Seller cannot be responsible for any damages of any kind that the Buyer or any third party may suffer as a result of the Seller fulfilling its obligations under an Order or for damages resulting from the use of Goods and Services after delivery, especially for loss of these.

15.3. By creating and using the Account, the User/Buyer assumes responsibility for maintaining the confidentiality of their Account data (username and password) and for managing access to the Account. To the extent permitted by current legislation, they are responsible for activities conducted through their Account.

15.4. By creating an Account and/or using Content and/or placing Orders, the Client/User/Buyer explicitly and unambiguously accepts the Terms and Conditions of the Site in their latest updated version, which is communicated on the Site and exists at the date of Account creation and/or Content use and/or Order placement.

15.5. "Archery One - my.archery.store" reserves the right to periodically update and modify this Document to reflect any changes to the operation of the Site or any changes in legal requirements. The document is binding on clients/users/buyers from the moment it is posted on the Site. In case of such modifications, the revised version of the Document will be posted, and you are encouraged to periodically check its content.

16. WRITING REVIEWS, COMMENTS, QUESTIONS, AND ANSWERS

Users/Clients/Buyers have the possibility to write Reviews, Comments, Questions, and Answers regarding the Goods and Services marketed on the Site.

16.1. A Review must contain the personal opinions of the Buyer about the product and their experience using it, for example:

- the opinion of the Buyer about the quality/price ratio;
- what they like and dislike about the product;
- what they would have wanted to know before purchasing the product;
- whether the product description should include additional information;
- whether they recommend the product to others;

- etc.

16.2. A Review should not:

- refer to experiences unrelated to the use of the product, such as interaction with the courier or delivery waiting times;
- contain questions or complaints about the product (for which we ask you to contact us directly);
- contain personal contact data or personal links;
- contain vulgar or offensive content;
- etc.

17. PROCESSING OF PERSONAL DATA

17.1. Please note that for accessing and using the Site, your personal data are processed by "Archery One - my.archery.store" in accordance with its own Privacy Policy, available on the website, which is an integral part of this Document.

19. FORCE MAJEURE

19.1. Neither party shall be responsible for non-performance of its contractual obligations if such non-performance, whether total or partial, within the deadline, is due to an event of force majeure. Force majeure is an unforeseen event beyond the control of the parties and which cannot be avoided.

19.2. If, within 15 (fifteen) days from its occurrence, the event does not cease, each party will have the right to notify the other of the full termination of the contract without either party being able to claim damages.

20. APPLICABLE LAW - JURISDICTION. CLAIMS AND COMPLAINTS. ALTERNATIVE DISPUTE RESOLUTION (ADR/ODR)

20.1. This document is subject to Romanian law. In the event of any disputes between the Seller and Users/Buyers, an attempt at amicable resolution will be made first. This chapter and the procedure below demonstrate the Seller’s willingness to resolve disputes quickly, efficiently, amicably, and extrajudicially, using all applicable legal mechanisms and measures in Romania.

20.2. For claims or complaints related to the Purchased Goods and/or Services, the Website functionalities, or illegal Content, Users/Buyers or any other interested persons may always submit a complaint via the contact form available on the Website. To file a claim or complaint, the appropriate form must be completed, including all fields marked as mandatory. The Seller will inform the person submitting the claim or complaint about its acceptance and, where applicable, about the decision taken, provided that contact details have been supplied. The maximum resolution period for claims or complaints is 30 calendar days from the date they are received.

If the Users/Buyers or any other interested persons:

- do not receive a response after 30 days from the Seller; or
- receive a response after this period from the Seller; or
- are dissatisfied with how the claim/complaint was managed by the Seller;


they may resort to the alternative resolution procedures (ADR/ODR) presented below and possibly subsequently to competent courts.

20.3. ADR (Alternative Dispute Resolution) is an alternative mechanism to the judicial system, offering consumers the possibility to resolve potential disputes related to the purchase of Goods and/or Services. Thus, claims or complaints against traders will be voluntarily submitted by consumers to be solved in an independent, impartial, transparent, rapid, and fair manner. Access to this alternative dispute resolution method can be done both online and through traditional methods, on paper or other durable media.

20.4. 20.5. Considering the provisions of Regulation (EU) No 524/2013 on online dispute resolution for consumer disputes, as amended by Regulation (EC) No 2006/2004 and Directive 2009/22/EC, the User/Buyer has the option to choose extrajudicial resolution of any disputes by using the European Online Dispute Resolution platform (the ODR platform), a digital tool created by the European Commission to facilitate independent, impartial, transparent, efficient, fast, and fair resolution of disputes concerning contractual obligations arising from online sales or service contracts between a consumer residing in the European Union and a trader established in the European Union.

20.6. The ADR (Alternative Dispute Resolution) and ODR (Online Dispute Resolution) do not represent two different mechanisms for resolving potential claims/complaints. The Buyer understands that alternative dispute resolution and online dispute resolution are part of a single mechanism, representing one and the same instrument, with identical purpose, scope, and finality. The Buyer also understands that the difference between SAL and SOL lies in the manner of access / initial format of the claim/complaint; thus, in the case of SAL, the consumer's approach is a classic one, in writing (by email, postal mail), whereas in the case of SOL, the consumer opts to use an existing form on a digital platform, exclusively online.

20.7. If amicable or alternative resolution of claims/complaints/disputes is not possible, or mutual consensus cannot be reached, these will be settled by the competent Romanian courts in Cluj County, Cluj-Napoca.

21. LIMITATIONS REGARDING CONTENT AND DIGITAL SERVICE

21.1. By accessing the Site in any way and by creating an Account, the User/Client/Buyer agrees to this Document and these Terms and Conditions, which form the contractual framework between "Archery One - my.archery.store" and them, governing the conditions and methods of using the Site.

21.2. Through the Site, "Archery One - my.archery.store" provides Users/Clients/Buyers with digital content and services. In this regard, "Archery One - my.archery.store" makes known that the main nature, purpose, and characteristic of the Site is to allow identification by the User/Client/Buyer of a Product and/or Service, adding it to “My Cart,” and placing Orders.

21.3. Therefore, "Archery One - my.archery.store" informs transparently that any other functionalities of the Site, such as but not limited to Favorites, List, Campaigns, Review, Rating, Comments, or any other alternative payment methods, are non-essential, accessory features, and "Archery One - my.archery.store" reserves the right to modify or eliminate these functionalities at any time, depending on its own commercial policy.

21.4. "Archery One - my.archery.store" reserves the right to make changes to the Site that may be based on:
a. The need to comply with legal requirements – modifications may include requesting additional documents, changing authentication procedures, as well as any modification to the Site interface based on implementing processes to ensure compliance with personal data protection, consumer protection, reporting illegal activities, and removing non-conforming content;
b. The desire to improve the Site interface by, for example, updating trademarks or other aesthetic aspects of the site's design;
c. The addition of features, functionalities, and the adaptation of the service or content for a higher degree of interoperability with other services and digital environments offered by "Archery One - my.archery.store" or its partners;
d. Modifying algorithms to offer more relevant content or to increase the engagement level of the User/Client/Buyer with the content;
e. The identification and reporting or removal of content uploaded by consumers that is protected by intellectual property rights or that violates the Document or the law;
f. Changing the technical specifications of the Site for security reasons such as preventing or removing spyware, malware, or combating the use of bots;
g. Creating, modifying, or decreasing the space allocated for advertising based on the commercial policy;
h. Limiting the Site's liability towards third parties.

21.5. For changes related to the functionalities of the Site concerning non-essential features and accessory functionalities, "Archery One - my.archery.store" reserves the right to make modifications at any time, test different interface versions, implement customized and dynamic functionalities, and remove them based on technical or commercial parameters or according to interactions of the platform’s users with different features.

21.6. Additionally, regarding all content and the digital service, "Archery One - my.archery.store" periodically implements updates to the interface, system, and security to ensure compliance of the Platform and to improve the experience of Users/Clients/Buyers. Therefore, updates related to the use of the online store hosted at my.archery.store and its subdomains will be made automatically.

21.7. If the content and digital services provided via the Site are not compliant due to the digital environment of Users/Clients/Buyers, they are obliged to cooperate, to the extent possible with the available technical means, to identify any incompatibilities or issues related to technical specifications.

22. INFORMATION ABOUT WEEE

22.1. Waste electrical and electronic equipment (Defined as WEEE according to current legislation) may contain hazardous substances that harm the environment and human health if not collected separately. In accordance with GEO 195/2005 – related to environmental protection, and GEO 5/2015 concerning waste electrical and electronic equipment, customers should consider the following:
a. Buyers are obliged not to dispose of waste electrical and electronic equipment (WEEE) as unsorted municipal waste and to collect WEEE separately;
b. Customers can donate WEEE free of charge at designated collection points specified at the time of purchasing a new product in the same category; thus, "Archery One - my.archery.store" applies a one-to-one collection policy for WEEE, in accordance with current legislation, if the handed-over equipment is equivalent and has performed the same functions as the new supplied equipment; customers of "Archery One - my.archery.store" can donate equivalent WEEE at all "Archery One - my.archery.store" showrooms.

23. GENERAL RULES FOR USING BOWS

23.1. What must be done  
The string of traditional bows and the cables of compound bows must be waxed periodically. This wax protects the strings from moisture and ensures their lubrication, significantly enhancing their longevity. Traditional bows should be stored by placing them horizontally on two elements positioned in such a way as to ensure an even distribution of the bow's weight between them, with the bow facing up or down. Always ensure that the shooting direction is well chosen and that the arrows fired cannot injure anyone, even if they miss the target or ricochet off something. It is always preferable to have something behind the target to stop arrows that miss: a safety net (does not guarantee the stopping of all arrows), a wall, earth, etc.  
The string should be placed on traditional bows only with the help of a bow-stringer, as many alternative methods pose the risk of damaging the bow by twisting one of its limbs, a defect not covered by any manufacturer if it occurs more than three months after the sale date. Always shoot with arrows that are suitable in spine and length for the strength of your bow.  
Never use fiberglass or wooden arrows with a compound bow.  
Do not use arrows that are too short, as there is a risk they may fall off the shelf/support/hand when drawing the bow.  
Always check the integrity of the bow and the string before shooting with that bow.  
Always check the integrity of each arrow before shooting it (shaft intact, nock intact, tip intact, feathers/vanes intact).  
Always check an arrow that has hit a hard element, even if that element is just another arrow.  
Respect the brace height zone recommended by the manufacturer.  
Use the bow and arrows only for their intended purpose: archery.  
Pay special attention, especially in situations where the archers are children. Bows are not toys and can pose significant risks even at low powers.

23.2. What must not be done  
The most destructive thing for a bow is dry firing: drawing the bow without an arrow and releasing the string. Without an arrow to absorb the energy stored in the bow, there is a risk that the bow's limbs may fail. Under these conditions, even the archer may be injured. A dry fire completely voids the bow's warranty, as dry firing is not covered by any manufacturer's warranty.  
The bow should not be stored in extreme conditions; excessive heat, cold, or humidity can cause damage. For example, the bow should not be left strung in a car during the summer, as there is a risk of it delaminating.  
The string should not be left on a solid wood bow after the shooting session is over.  
The bow cannot be stored standing, leaning against a wall.  
Do not shoot arrows straight up.  
Do not shoot at other people or animals.  
Do not string the bow using techniques other than the bow-stringer technique.  
Do not shoot with arrows that are too soft for your bow, as there is a risk of them breaking in the bow.  
A string made of Fast-Flight material (or Fast-Flight type: D97, Spectra, BCY 8125...) should not be used on a bow that only supports Dacron strings (or Dacron type: B50, B55,...), as there is a risk of breaking it. The manufacturer of each bow can tell you if the specific bow supports Fast-Flight type strings.  
Do not draw the bow more than recommended by the manufacturer.  
Do not shoot with the bow using arrows where the gpp (grains per pound) is below the value recommended by the manufacturer.  
Do not walk on the street with the bow and arrows in plain sight. Put the arrows in a tube or box and remove the string from the bow.  
Do not use the bow and arrows in any way that could result in injury to a person or an animal.
